These Terms and Conditions ("Terms") govern your access to and use of Keeps, a mobile application for capturing, collecting, organizing, and sharing stamp-framed photos ("Keeps," the "App," or the "Service").

Please read these Terms carefully. By creating an account, accessing, or using Keeps, you agree to these Terms. If you do not agree, do not use the App.

Legal review note: This document is a detailed product-specific draft based on the current Keeps app behavior. It is not legal advice. Before publishing, Nosiah Studio should have it reviewed for the jurisdictions where the App will be offered.

1. Service Provider

References to "we," "us," and "our" mean Nosiah Studio. References to "you" and "your" mean the person or entity using Keeps.

2. Eligibility

You may use Keeps only if you can legally enter into these Terms and comply with them.

Keeps is not intended for children under 13, or the minimum age required by law in your country or region. If you are old enough to use Keeps but not old enough to enter into a binding agreement on your own, you may use Keeps only with permission from a parent or legal guardian.

You may not use Keeps if:

• You are prohibited from using the Service under applicable law.
• We previously suspended or terminated your account for violating these Terms.
• You intend to use Keeps for unlawful, harmful, abusive, or deceptive activity.

3. Accounts and Sign-In

Most Keeps features require an account. Keeps uses third-party sign-in providers, including Apple and Google, through Supabase authentication.

You are responsible for:

• Keeping your sign-in credentials secure.
• Keeping your account information accurate.
• All activity that occurs under your account.
• Notifying us if you believe your account has been accessed without permission.

You may not:

• Create an account using false, misleading, or unauthorized information.
• Impersonate another person or organization.
• Use another person's account without permission.
• Attempt to bypass authentication, account limits, subscription controls, or security protections.

4. Profile Information

Keeps may allow you to create or edit profile information such as display name, username, bio, and avatar.

You agree that your profile information must not:

• Infringe another person's rights.
• Mislead other users about who you are.
• Contain hateful, harassing, sexually explicit, exploitative, illegal, or harmful content.
• Include private information about another person without permission.

We may remove or restrict profile information if we reasonably believe it violates these Terms or creates legal, safety, or security risk.

5. Keeps Features

Keeps may allow you to:

• Capture stamp-framed photos using your device camera.
• Select available stamp machine frames.
• Add captions to stamps.
• Set stamps as public or private.
• View stamps in calendar, collection, profile, and detail views.
• Organize stamps into default and custom collections.
• Create scrapbook/page projects.
• Add friends, receive friend requests, and manage friend relationships.
• View public stamps from friends or other visible social areas.
• React to stamps with emoji-style reactions.
• Reply to a public friend stamp with a message or reaction.
• Chat with accepted friends.
• Add home screen widgets, including a camera shortcut widget and latest-stamp widget.
• Subscribe to Keeps Pro for additional features, higher limits, and paid plan benefits.

Features may change over time. We may add, modify, limit, suspend, or remove features when reasonably necessary, including for product improvement, maintenance, security, legal compliance, fraud prevention, or operational reasons.

6. Basic and Pro Plans

Keeps may offer a free plan ("Keeps Basic") and a paid plan ("Keeps Pro").

Keeps Basic may include limits such as:

• Access only to selected stamp machine frames.
• A maximum number of custom collections.
• A maximum number of friends.
• Limited editing after saving a stamp.
• A maximum number of scrapbook/page projects.

Keeps Pro may include benefits such as:

• Access to all available stamp machine frames.
• Higher or unlimited collection limits.
• Higher friend limits.
• Ability to edit saved stamp captions and visibility where the feature is available.
• Higher or unlimited project limits.
• Access to future Pro features, where offered.

The exact plan benefits, limits, prices, and availability shown in the App or app store at the time of purchase or use apply. We may modify plan features over time, but we will not intentionally remove paid access during a paid period except where required by law, app store rules, security needs, or violation of these Terms.

7. Subscriptions, Lifetime Purchases, and Billing

Keeps Pro may be offered as monthly, yearly, or lifetime purchase options. Purchases are processed by Apple App Store or Google Play. Subscription and entitlement validation may be managed through RevenueCat.

By purchasing a paid plan, you agree to:

• The price, billing period, and renewal terms shown at purchase.
• The applicable Apple App Store or Google Play payment terms.
• Any taxes, fees, or currency conversion applied by the app store or payment provider.

Subscriptions automatically renew unless cancelled according to the app store's cancellation rules. You can manage or cancel subscriptions through your Apple App Store or Google Play account settings.

We do not receive or store your full payment card details. Refunds, chargebacks, billing corrections, and payment disputes are generally handled by Apple or Google, unless applicable law requires otherwise.

8. Paid Access Belongs to the Purchasing Account

A subscription or lifetime purchase is intended for the Keeps account that purchased it. Paid access is not intended to be transferred, sold, shared, rented, or resold to another Keeps account.

If you sign out and sign in with a different Keeps account on the same device, Pro access may not apply to the other account. If the App detects that a lifetime purchase or subscription is already connected to another account, you may be asked to sign in with the account that originally bought it.

You are responsible for making purchases while signed into the correct Keeps account and app store account.

9. Trials, Promotions, and Price Changes

We may offer free trials, discounts, promotional pricing, or limited-time offers. Eligibility and availability may vary by user, platform, region, app store account, or purchase history.

If a trial is offered, it may convert to a paid subscription unless cancelled before the trial ends, as disclosed by the app store at purchase.

Prices may change in the future. Any renewal price changes will be handled according to app store rules and applicable law.

10. User Content

"User Content" means content you create, upload, save, send, or share through Keeps, including:

• Stamp photos.
• Captions.
• Public/private stamp settings.
• Profile names, usernames, bios, and avatars.
• Collection names and organization.
• Scrapbook/page project content.
• Friend requests and social interactions.
• Chat messages.
• Reactions.
• Stamp replies.

You keep ownership of your User Content. By using Keeps, you grant Nosiah Studio a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, transmit, and otherwise use your User Content only as needed to:

• Provide the Service.
• Display your content to you and to users you choose or permit.
• Support public/private stamp visibility.
• Operate chat, reactions, friend feeds, collections, calendar views, projects, and widgets.
• Maintain, secure, debug, and improve the App.
• Comply with legal obligations and enforce these Terms.

This license ends when your User Content is deleted from the Service, except where retention is reasonably necessary for backups, legal obligations, security, fraud prevention, dispute resolution, or content already shared with another user where immediate deletion is not technically or legally required.

11. Your Responsibility for User Content

You are solely responsible for your User Content and represent that:

• You own it or have permission to use and share it.
• It does not violate another person's intellectual property, privacy, publicity, or other rights.
• It does not violate law or these Terms.
• It is not harmful, abusive, exploitative, deceptive, or malicious.

You should not upload or share photos, captions, messages, or profile information that you would not want others to see if made public or sent to another user.

12. Public and Private Stamps

Keeps lets you choose whether certain stamps are public or private.

Private stamps are intended to be visible only to you, except as needed to operate, secure, and maintain the Service.

Public stamps may be visible to other authenticated Keeps users, your accepted friends, or social feed/profile surfaces depending on the feature. Public stamp information may include the stamp image, caption, owner display name, owner username, avatar, and capture date or related metadata.

If you reply to a friend's public stamp, information about that stamp, such as stamp ID, storage path, and caption, may be included in the chat reply so the conversation can show what you replied to.

Changing a stamp from public to private may limit future visibility, but it may not remove copies, screenshots, cached content, or messages already viewed or saved by others.

13. Friends, Social Feed, Reactions, and Chat

Keeps social features are designed for interaction between users, especially accepted friends.

You agree not to use social features to:

• Harass, threaten, bully, abuse, stalk, or intimidate others.
• Send unwanted spam, promotions, scams, phishing attempts, or deceptive messages.
• Share another person's private information without permission.
• Send illegal, hateful, sexually explicit, exploitative, violent, or self-harm-promoting content.
• Encourage harm, abuse, fraud, or unlawful activity.
• Circumvent friend limits or safety controls.

Messages and reactions are visible to the sender and receiver. We may access, preserve, review, restrict, or disclose social content when reasonably necessary to operate the Service, enforce these Terms, respond to support or safety issues, comply with law, or protect rights and safety.

14. Prohibited Conduct

You may not:

• Violate any applicable law or regulation.
• Use Keeps to exploit, harm, or endanger minors.
• Upload malware, malicious code, or content designed to damage systems.
• Attempt to gain unauthorized access to Keeps, Supabase, RevenueCat, app store systems, or other users' accounts.
• Interfere with or disrupt the App, servers, networks, storage, or security systems.
• Scrape, crawl, harvest, or bulk-download user data or content without permission.
• Reverse engineer, decompile, or attempt to extract source code except where allowed by law.
• Bypass subscription limits, entitlement checks, plan restrictions, or account ownership rules.
• Use automated scripts or bots to create accounts, send messages, add friends, or manipulate the Service.
• Misrepresent your identity or relationship with another person or organization.
• Use Keeps for commercial surveillance, unauthorized facial recognition, or other invasive monitoring.

15. Moderation and Enforcement

We may investigate activity or content that we believe may violate these Terms. Where appropriate, we may:

• Remove or restrict User Content.
• Limit visibility of content.
• Disable public sharing or social features.
• Suspend or terminate accounts.
• Refuse, suspend, or revoke access to paid features if the account violates these Terms.
• Report unlawful activity to appropriate authorities.
• Preserve information where required or permitted by law.

We are not obligated to monitor all content, and we cannot guarantee that all harmful content will be removed immediately.

16. Device Permissions

Keeps may request device permissions, including:

• Camera access, to capture stamp photos.
• Photo library or storage access, where needed to select, save, export, or share images.
• Internet access, to sign in, sync content, upload and load photos, send messages, validate purchases, and use cloud features.

You can manage device permissions in your operating system settings. Some features may not work if permissions are denied or revoked.

17. Home Screen Widgets

Keeps may allow you to add widgets to your device home screen. Widgets may display limited content such as a camera shortcut, latest stamp, caption, friend name, friend avatar, image URL, and update time.

Widget content may remain visible on your device lock screen or home screen depending on your device settings. You are responsible for managing widget visibility on your device.

18. Account Deletion

You may request account deletion through the App where available or by contacting us at nosiahstudio@gmail.com.

When an account is deleted, we will delete or de-identify account data associated with that account, subject to:

• Reasonable processing time.
• Backups and technical logs.
• App store and payment processor records.
• Legal, tax, accounting, fraud prevention, safety, security, or dispute-resolution requirements.
• Content that has been sent to another user, such as chat messages, where retaining the other user's conversation record may be necessary unless deletion is legally required.

Deleting your Keeps account does not automatically cancel an active Apple App Store or Google Play subscription. You must cancel subscriptions through the relevant app store account settings.

19. Intellectual Property

Keeps, including its software, interface, designs, branding, logos, icons, visual assets, documentation, and other materials, is owned by Nosiah Studio or its licensors and is protected by intellectual property laws.

Except for the limited right to use Keeps under these Terms, you do not receive any ownership rights in the App or Service.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from Keeps unless expressly permitted by these Terms or applicable law.

20. Feedback

If you send us feedback, suggestions, ideas, bug reports, or feature requests, you grant us permission to use them without restriction or compensation. We are not required to implement feedback.

21. Third-Party Services

Keeps relies on third-party services, including:

• Supabase for authentication, database, storage, and realtime features.
• Apple and Google for sign-in, app distribution, device permissions, and in-app purchase processing.
• RevenueCat for subscription and entitlement management.
• Device operating system services for camera, storage, widgets, and app links.

Third-party services are governed by their own terms and policies. We are not responsible for third-party services we do not control.

22. Service Availability

We try to keep Keeps reliable, but we do not guarantee uninterrupted, secure, or error-free operation. Keeps may be unavailable, delayed, or limited due to:

• Maintenance or updates.
• Network problems.
• Device or operating system limitations.
• Supabase, RevenueCat, Apple, Google, or other third-party outages.
• Security incidents or emergency fixes.
• Legal or compliance restrictions.

23. Changes to Keeps

We may change, suspend, or discontinue any part of Keeps at any time. If a change materially affects paid features during an active paid period, we will handle the change according to applicable law and app store requirements.

24. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you, such as through the App or by updating the effective date.

Continued use of Keeps after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using Keeps.

25. Disclaimers

Keeps is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, reliability, and accuracy.

We do not guarantee that:

• Keeps will always be available.
• Photos, messages, collections, projects, or other data will never be lost.
• Public/private settings will prevent all copying, screenshots, caching, or misuse by other users.
• Paid features will be available on every device, platform, region, or app store account.
• The App will meet every expectation or be free from defects.

Nothing in these Terms excludes warranties, guarantees, rights, or remedies that cannot be excluded under applicable law.

26. Limitation of Liability

To the maximum extent permitted by law, Nosiah Studio will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, business opportunities, or reputation, arising from or related to your use of Keeps.

To the maximum extent permitted by law, our total liability for claims arising from or related to Keeps or these Terms will not exceed the greater of:

• The amount you paid to Keeps through the App in the 12 months before the claim; or
• USD 50.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitation applies only to the maximum extent permitted by law.

27. Indemnity

To the extent permitted by law, you agree to indemnify and hold Nosiah Studio harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from:

• Your User Content.
• Your misuse of Keeps.
• Your violation of these Terms.
• Your violation of another person's rights.
• Your violation of applicable law.

28. Termination

You may stop using Keeps at any time. You may request account deletion as described above.

We may suspend or terminate your access to Keeps if:

• You violate these Terms.
• Your use creates legal, security, safety, or operational risk.
• We are required to do so by law or a third-party platform.
• We discontinue the Service.

Termination does not automatically cancel active app store subscriptions. You must manage subscriptions through Apple App Store or Google Play.

29. Governing Law

These Terms are governed by the laws of the United States and applicable international laws, treaties, and conventions, unless mandatory consumer protection, privacy, or platform laws in your country or region require another law to apply.

30. Dispute Resolution

If you have a concern or dispute, please contact us first at nosiahstudio@gmail.com so we can try to resolve it informally.

If a dispute cannot be resolved informally, it will be handled in the courts or dispute-resolution forums available under applicable law.

31. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect. The invalid or unenforceable part will be interpreted to the maximum extent permitted by law to achieve its intended purpose.

32. Entire Agreement

These Terms, together with the Privacy Policy and any app store purchase terms that apply to your transaction, form the entire agreement between you and Nosiah Studio regarding Keeps.
